1. Acceptance of Terms

By accessing or using the HulkPush platform, website, API, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization and represent that you have the authority to do so.

If you do not agree to these Terms, you may not access or use the Service. We recommend reviewing these Terms periodically, as your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

HulkPush provides a web push notification platform that enables website owners to send browser-based push notifications to their subscribers. The Service includes, but is not limited to, notification delivery, subscriber management, analytics, audience segmentation, drip campaigns, and API access.

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with or without notice. We may also impose limits on certain features or restrict access to parts of the Service without liability.

The Service is provided on an "as-is" basis. While we strive for high uptime and reliability, we do not guarantee uninterrupted or error-free operation of the platform.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration.

You must notify us immediately of any unauthorized use of your account or any other security breach. HulkPush will not be liable for any loss arising from your failure to safeguard your account information.

We reserve the right to suspend or terminate accounts that we reasonably believe are in violation of these Terms, have been inactive for an extended period, or pose a security risk to the platform.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to send unsolicited or spam notifications, distribute malware or harmful content, harass or deceive recipients, or violate any applicable local, national, or international law or regulation.

You must obtain proper consent from your subscribers before sending push notifications. You are solely responsible for the content of your notifications and for ensuring compliance with all applicable privacy and data protection laws, including but not limited to GDPR, CCPA, and CAN-SPAM.

HulkPush reserves the right to review and remove any content that violates these Terms or that we determine, in our sole discretion, to be harmful, offensive, or otherwise inappropriate.

5. Payment Terms

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, depending on the plan you select. All fees are non-refundable except as expressly provided in these Terms or as required by applicable law.

We reserve the right to change our subscription fees at any time. We will provide at least 30 days' notice of any price changes to existing subscribers. If you do not agree to the new pricing, you may cancel your subscription before the next billing cycle.

Failure to pay subscription fees may result in suspension or termination of your access to paid features. You are responsible for any applicable taxes associated with your use of the Service.

6. Intellectual Property

The Service, including all associated software, designs, text, graphics, logos, and trademarks, is the property of HulkPush or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

You retain all rights to the content you upload or transmit through the Service. By using the Service, you grant HulkPush a limited, non-exclusive license to use, display, and distribute your content solely for the purpose of providing and improving the Service.

7. Limitation of Liability

To the maximum extent permitted by law, HulkPush and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service.

In no event shall our total liability exceed the amount you have paid to HulkPush in the twelve (12) months preceding the claim. This limitation of liability applies regardless of the legal theory on which the claim is based, whether in contract, tort, negligence, strict liability, or otherwise.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.

8. Termination

You may terminate your account at any time by contacting our support team or through the account settings in your dashboard. Upon termination, your right to use the Service will immediately cease, and we may delete your account data in accordance with our data retention policies.

We may terminate or suspend your account and access to the Service immediately, without prior notice, if we determine that you have violated these Terms, engaged in fraudulent or illegal activity, or if required to do so by law.

Sections of these Terms that by their nature should survive termination, including but not limited to intellectual property provisions, warranty disclaimers, and limitations of liability, shall survive termination.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising from or relating to these Terms or the Service shall be resolved exclusively in the courts located in India.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email or by posting a prominent notice on the Service prior to the changes becoming effective. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of those changes.

We encourage you to review these Terms periodically for any updates. If you do not agree with the modified Terms, you should discontinue your use of the Service and close your account.
